ORDER NOTICE REQUIREMENT FOR ALL ORDERS

All regular, non-cake bakery orders require at least a 72-hour notice. Items may be able to be available sooner if order is discussed with a bakery representative prior to placing the order. Any orders that are for cakes, cupcakes, iced sugar cookies, or other custom decorated items, large gatherings, or events may require additional notice. Please call prior to placing a large order or it may be denied and any money paid returned. The bakery will try to accommodate the needs of our customers whenever possible. In some cases, the ingredients or packaging must be specially ordered and that is why there may be a need for additional time.

TERMS & CONDITIONS FOR BAKERY REWARDS

By accepting and using the Bakery Rewards Card or the "card" you are agreeing to all the terms and conditions listed within this section:

   1.    The Bakery Rewards card is good for one year from the date written on it by a bakery representative.

   2.    The intent to use the card to redeem money off of your order must be mentioned at the time the order is placed. 

   3.    This card can only be used by the person named on the card and is non-transferable.

   4.    This card cannot be replaced if lost or stolen.

   5.    This card cannot be combined with any other discounts or offers.

   6.    This card cannot be applied to delivery or other fees.

   7.    The Bakery Rewards Card has no cash value and may not be redeemed for cash.

   8.    If using the card toward the purchase of an item that is less than $5.00, change will not be given and the remaining balance will

          be forfeited.

 

DEFINITIONS
The “Seller” is defined as the legal entity Puluso’s Country Bakery, LLC. The “Buyer” means the person (legal or natural) who buys the goods. “Goods” is defined as the items to be supplied by the Seller to the Buyer as listed in the invoice or other order form.

 

GENERAL
These Terms and Conditions shall apply to the sale of the Goods by the Seller to the Buyer to the exclusion of all other terms and conditions referred except where the Seller has agreed to such variation in writing and by way of signature. By ordering from Puluso’s Country Bakery, LLC you agree to be legally bound by these Terms and Conditions (“Conditions”) and accept that these Conditions may be modified or amended on occasion for any reason that the Seller has deemed necessary. The Terms and Conditions will be updated on all quotes, contracts, promotional literature (if necessary), website, social media or anywhere the Terms and Conditions may be located. If the change affects current quotes, contracts, or clients in any way, clients affected will be notified in writing and may be asked for confirmation signature. Any of the Terms and Conditions can be modified in writing between Seller and Buyer should the need arise and as determined on a case by case basis by Seller. Any fees, surcharges, penalties, or no refund policies can be excluded or waived for the Buyer at Seller's discretion.

 

PAYMENT AND DEPOSIT  

 

FOR REGULAR BAKERY ORDERS: Payment in full is due at time of order. 

 

FOR CAKES: In most instances (and all instances where the order is over $100), we require a 25% non-refundable deposit to confirm an order. The remaining 75% is due 2 weeks before the delivery date, at which point all changes must be confirmed (changes to the previously agreed design or order may incur extra charges). Orders placed less than 2 weeks in advance of the delivery date must be paid in full. The final balance specified on the invoice must be paid by the Buyer within 5 days from the date of the invoice. Payment can be made earlier if you wish. Failure to complete payment within 5 days from the date of the invoice may result in your order being cancelled. Deposits are non-refundable. Full payments made less than 2 weeks in advance of the delivery date are non-refundable. Full payments made more than 2 weeks in advance of the delivery date are subject to a cancellation fee if cancelled more than 2 weeks in advance of the delivery date (see “Cancellations and Alterations” clause of these “Conditions”). 

 

CONSULTATIONS
Consultations are by appointment only and are not applicable to all orders. An appointment for a consultation and tasting must be agreed on with Puluso’s Country Bakery, LLC by email or written form and the consultation fee must be paid no later than 7 days prior to consultation date before it can be confirmed. All appointments for consultations will be confirmed in writing by Puluso’s Country Bakery, LLC.

 

PRICE QUOTATIONS
All price quotations, written or verbal, are valid for 30 days from the date of quotation unless otherwise stated by Seller at the time the quote is given.

 

CANCELLATIONS AND ALTERATIONS
If you have any questions, concerns, or need to make any changes to an order please contact us immediately. We will assess your request for an alteration and let you know its effect on the price and any agreed timetable. Accepting any alterations is at the discretion of the Seller. Alterations requested less than 2 weeks before completion may be subject to a surcharge. We cannot refund any of the cost of any cake orders of $75 or more or bakery orders of $100 or more if cancelled with less than 2 week’s notice. Orders paid in full and cancelled with more than 2 weeks notice but less than 30 days will receive a partial refund of 50% of the total amount paid. Any order that was paid in full and cancelled 30 days or more in advance will receive a full refund.  In the unlikely event that we have to cancel your order for any reason, then we will give you as much notice as possible, and discuss the matter with you and try to agree to a suitable alternative. If you are not willing to accept our suggested alternative, then we will refund the full price to you. 

 

DAMAGES
In the unlikely event that your order arrives damaged, it is the customer’s responsibility to report the damage to us within 48 hours and send photographic evidence of the damage within three working days if you wish to claim a refund or replacement. The Seller will not take back any undamaged goods from the Buyer unless agreed in writing by the Seller. The Seller accepts no liability for cakes or bakery orders that are damaged after they have been delivered to the agreed location. For cakes or bakery orders delivered to venues, the Seller requires a signed delivery form by the Person In Charge to say that the cake or bakery order has arrived and that it arrived in perfect condition. Cakes or bakery orders picked up from the Puluso’s Country Bakery, LLC studio (pick up is by appointment only) require a signed collection form by the Person In Charge to say that the cake or bakery order was collected in perfect condition. Damages after this point are not Puluso’s Country Bakery, LLC’s responsibility. If a prenamed Person In Charge named by Buyer is not available or unable to be located/reached at the designated time of delivery, then at the seller’s discretion, the order may be returned to the studio at which time, the Buyer may come pick up their cake/bakery order or have it redelivered for a prepaid surcharge (via PayPal or other Seller determined method) of no less than $45 plus current mileage rate of $0.58 per mile. All Puluso’s Country Bakery, LLC’s cakes and bakery orders are fragile and require special care and attention when handling, storing and displaying. Please pay careful attention to our storage and transportation instructions (where relevant) that will be provided with the cake or bakery order. Where samples of the Goods are shown to the Buyer, the Buyer hereby accepts that they consider such samples to be representative of the Goods. Any description applied to the Goods is only given by way of identification and does not constitute a sale by description.
